Agreement & Acceptance

Welcome to Moments of Sonder Travel. These Terms and Conditions constitute a binding legal agreement between you ("Customer") and Moments of Sonder, LLC ("Moments of Sonder Travel," "we," "us," or "our"). Please read them carefully before engaging our services.

By any of the following actions, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety:

These Terms apply to you, your family, and any traveling companions on whose behalf you make bookings or payments. You represent that you are at least 18 years of age and have the legal authority to enter into this agreement.

You agree to supervise all use of Moments of Sonder Travel services by minors under your name or account, and warrant that all information provided by you or members of your household is true and accurate. Speculative, false, or fraudulent reservations are strictly prohibited.

Advisory Fees, Lead Time & Service Terms
Planning & Advisory Fees

Moments of Sonder Travel charges professional advisory and planning fees that are separate from and not applied toward the cost of any travel, accommodation, or supplier service. These fees compensate Moments of Sonder Travel for professional expertise, research, itinerary design, and booking management services rendered.

All planning and advisory fees are non-refundable, regardless of whether travel proceeds. This includes the $75 consultation call fee. Fees are confirmed in writing prior to engagement and are due before planning commences.

Consultation Call

A $75 consultation call fee is required to initiate engagement for all service tiers except The Reserve (Tier Zero hotel bookings). This fee is applied as a credit toward the planning fee of the service tier selected if the Customer proceeds. If the Customer does not proceed following the consultation call, the $75 fee is non-refundable.

90-Day Lead Time & Expedited Service Fee

All planning engagements are expected a minimum of 90 days before the intended travel date. For travel departing within 90 days of initial inquiry, a 20% expedited service fee is added to the applicable planning fee. This fee reflects the additional urgency, supplier outreach, and compressed timeline required to deliver Moments of Sonder Travel's standard of service.

The Reserve, Hotel-Only Bookings

The Reserve (Tier Zero) is a hotel booking service that does not require a consultation call or planning fee. For hotel bookings with a total accommodation value of $2,500 or more, no advisory fee is charged; Moments of Sonder Travel earns a commission from the property. For bookings under $2,500, a $50 booking fee applies. One amendment (date change, room type adjustment, or similar modification) is included. Additional amendments may incur a fee.

Agency Relationship & Limitation of Liability

Moments of Sonder Travel offers retail travel services to customers, which are provided by separate and independent vendors of travel services ("Suppliers"). Moments of Sonder Travel acts only as a sales agent for any airline, air charter, boat purveyor/owner, bus company, car-rental company, cruise line, ground operator, ground transportation, hotel, tour operator, shore excursion, attractions, or other travel Suppliers who provide goods or services for the Customer trip. Suppliers may also engage the services of local operators and sub-contractors. Each of these Supplier companies is an independent entity with its own management and is not subject to the control of Moments of Sonder Travel.

The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased. All bookings are accepted by Moments of Sonder Travel as a booking agent for services provided by the travel Suppliers on your itinerary. The transportation, accommodations, and other services provided are subject to the terms and conditions contained in the tickets, exchange orders, or vouchers issued by Suppliers and/or their websites.

Limitation of Liability: While Moments of Sonder Travel selects top-quality Suppliers, we assume no responsibility for and shall not be liable for any refund, cancellation, delay, diversion or substitution of equipment; loss or damage to baggage or property; injury, illness, or death; or any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, caused by: (1) any defaults, wrongful or negligent acts, errors, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other person or party not employed by or under the exclusive control of Moments of Sonder Travel.

Moments of Sonder Travel hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special, consequential, incidental or indirect damages, in connection with the goods or services provided by any Supplier. Suppliers reserve the right to deviate from the direct, customary, and/or scheduled route or itinerary for any reason, without limitation and without notice.

Air carriers, rail, coach, and ship cruise companies are not to be held responsible for any act, omission, or event during the times that passengers are not aboard their aircraft or conveyances. Moments of Sonder Travel is not responsible for any criminal conduct by third parties.

Customer acknowledges and agrees that Moments of Sonder Travel has solely received commission and fees for travel transactions. Any recovery from Moments of Sonder Travel will be limited to the commission and fees actually received by Moments of Sonder Travel from the Customer's booking.

The international carriage of passengers is subject to international conventions and treaties, where applicable. These international agreements limit and, in some cases, exclude the carrier's liability to travelers. Where any claim involves travel arrangements provided by any air, sea, inland waterways, rail, or road carrier or any stay in a hotel, our maximum liability is the maximum which would be payable by the carrier or hotel keeper concerned under applicable international convention or regulation (for example, the Warsaw Convention, the Montreal Convention).

Local Laws & Conduct

During travel, you must always comply with the laws and regulations of all places visited. Committing any illegal act may result in cancellation of your trip and puts you at risk of fines or punishment by local authorities, for which Moments of Sonder Travel cannot be held responsible. Each foreign country holds different views of past criminal offenses. If you have a current or past offense and are unsure how the country you are traveling to views that offense, please contact that country's embassy or consulate directly. Moments of Sonder Travel will not be held responsible for any trip interruptions, cancellations, or costs incurred by failure to comply with these requirements.

Pricing, Payments & Cancellations
Pricing

Pricing and availability may change without notice. Customer agrees that Moments of Sonder Travel is not responsible for any errors or omissions in any quotes or advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, nor is Moments of Sonder Travel responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published price that it determines was erroneous due to electronic, printing, or clerical error.

All advertised prices and costs are in U.S. currency unless noted otherwise. Prices are not subject to increase after you make full payment, except due to: (a) transportation cost changes (e.g. fuel surcharges); (b) government action such as VAT or other government-imposed increases; (c) adverse currency exchange rate variations. Customer acknowledges and consents to any post-purchase price increases in relation to these categories.

Payments

Unless otherwise specified during the reservation process, final payment is due prior to departure according to each Supplier's terms and conditions. If full payment is not received by the applicable due date, reservations are subject to cancellation and deposits may be forfeited.

When making payments, you authorize Moments of Sonder Travel or its partners to process transactions through third-party payment processors that comply with PCI-DSS standards. You agree to: (a) authorize the processing of your payment for travel-related services; (b) resolve any disputes directly with relevant parties; (c) provide accurate payment information.

Cancellations

All cancellation requests must be submitted to Moments of Sonder Travel in writing. Planning and advisory fees paid to Moments of Sonder Travel are non-refundable under all circumstances. For amounts paid to Suppliers, cancellation policies vary by Supplier and are communicated at the time of booking. In some cases, there is NO REFUND once a booking is made and paid for.

Cancellation penalties are advised at time of booking. All cancellation fees will be charged to the credit card authorized for payment or deducted from any Supplier refund. Customer acknowledges that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and that you may be bound by those contracts regardless of whether you receive notice of their terms.

Important: Moments of Sonder Travel is not responsible for Supplier cancellations, deviations, delays, mandated overnight stays, missed connections, failure to deliver, partial delivery of services, fuel increases, or other matters outside of Moments of Sonder Travel's control.

Force Majeure

"Force Majeure" means any circumstances beyond the reasonable control of Moments of Sonder Travel, including but not limited to: acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences.

Moments of Sonder Travel shall not be deemed to be in breach of these Terms, nor shall Moments of Sonder Travel be liable for any delay or non-performance of its obligations to the extent that such delay or non-performance is due to any Force Majeure. Moments of Sonder Travel shall not be held responsible or liable in any way due to any Force Majeure, including death, bodily injury, illness, damage, delay, or other losses caused by such events.

Additionally, Moments of Sonder Travel shall not be responsible for any loss or damage incurred by you as a result of any Supplier's inability to fulfill its obligations due to a force majeure event beyond the Supplier's control. If Moments of Sonder Travel and/or any of its travel Suppliers are affected by Force Majeure, they shall be entitled to vary or cancel any itinerary or arrangement. Payment of any refund by Moments of Sonder Travel to you as a result shall remain in its sole and absolute discretion, though Moments of Sonder Travel shall use reasonable efforts to reimburse where possible.

Regarding civil unrest: once Moments of Sonder Travel has investigated the prevailing situation as it deems fit, it shall remain in Moments of Sonder Travel's sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip subject to Moments of Sonder Travel's and each Supplier's terms and conditions.

Weather & Natural Events

Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall, are not guaranteed and are clearly outside of Moments of Sonder Travel's control. Volcanic eruptions, ash clouds, and wind may be characterized as an adverse weather condition or a natural disaster by Suppliers and your travel insurance company, which is beyond the control of Moments of Sonder Travel. Moments of Sonder Travel shall not assume any responsibility for any air and/or ground schedule changes caused by weather or natural events.

Moments of Sonder Travel reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary, and to refuse to accept or to retain as a member of any tour any person at any time.

Passports, Visas & Entry Requirements
Customer Responsibility

Each Customer is responsible for determining the passport, visa, identification, and entry requirements that apply to them. Requirements are subject to change, often without notice. Moments of Sonder Travel recommends you verify requirements with the relevant embassy or consulate, and review information at travel.state.gov. Ultimately, it is the responsibility of each traveler to understand and comply with all entry requirements, carry proper travel documents, and pay any Entry and Exit Fees required by applicable government regulations.

Passports

Passports are required for all U.S. citizens and citizens of other countries traveling abroad. Many countries will not admit a passenger if their passport expires within six months of the date of entry. Depending on the destination, your passport may need to be valid for longer than six months after your return date. Some countries require a specific number of blank visa pages. Non-U.S. citizens may require additional documentation. Customer is responsible for making Moments of Sonder Travel aware when traveling on a passport from a country other than the USA. Children and infants also require all such travel documents.

Minors traveling with one parent, without both parents, or with a parent of a different surname may be stopped and not admitted unless authenticated consent forms are provided. Please see CBP.gov for the relevant forms.

The names of all travelers must be provided exactly as they appear on their passport, including titles, multiple first names, middle names, and last names. The name, date of birth, and gender that appear on the passport must exactly match the airline ticket and booking records. Errors not corrected prior to travel could prevent boarding or entry to some countries and may require the purchase of new airfare.

Visas & Immunizations

Travel visas are required for many countries. You are responsible for determining the visa requirements that apply to you. Moments of Sonder Travel neither controls nor warrants the issuance of visas. Should a visa not be issued, Moments of Sonder Travel is not responsible for lost payments made toward the contemplated trip. Some countries also require proof of immunization against certain diseases. Each Customer is responsible for having the proper immunizations and required documentation before travel. Moments of Sonder Travel shall not assume responsibility for the accuracy of health requirements or vaccination requirements prior to departure or upon landing.

Entry & Exit Fees

Some countries, airports, or ports may require payment of entry or exit fees, border crossing fees, or other taxes upon arrival or departure, which must be paid directly by the traveler and cannot be included in pricing provided by Moments of Sonder Travel. Moments of Sonder Travel will do its best to inform you of such fees, but is not responsible for omissions or errors.

Travel Risk & Safety

Travel to certain destinations may involve greater risk than others. Moments of Sonder Travel urges customers to remain informed on a daily basis as to current news events and to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking international travel.

You assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Moments of Sonder Travel from all claims arising out of any problem covered in this section. All suits in connection with this agreement shall be litigated, if at all, in the courts of Contra Costa County, California.

Travel Insurance
Travel insurance is strongly recommended on all trips and is presented as a standard part of the planning and booking process at Moments of Sonder Travel. We recommend purchasing coverage at the time of your first trip deposit, not at the time of departure, to maximize coverage eligibility, including for pre-existing medical conditions where applicable.

As your travel agent, Moments of Sonder Travel has a professional responsibility to recommend the purchase of travel insurance to cover risks inherent in travel, including:

Moments of Sonder Travel can provide a quote through preferred insurance partners. You may also purchase coverage through a provider of your choice. Moments of Sonder Travel is not a licensed insurance agent; all policy questions and claims are handled directly with the insurance provider. Moments of Sonder Travel has no control over the travel insurance provider's coverage decisions and is not responsible for policy coverage, claims processing, or the denial of any claims.

By declining appropriate travel insurance, Customer acknowledges and accepts full liability for any cancellation penalties, damages, and/or out-of-pocket expenses incurred. Where travel insurance is declined, Customer's confirmation documentation will note the declination.

Power of Attorney

As our client, you hereby appoint Moments of Sonder Travel to be your attorney-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, insurance, and hotel guarantees. You authorize Moments of Sonder Travel to make credit card authorizations for said purchases whenever it receives an online, phone, or email booking request reasonably believed to be from you or someone acting on your behalf, requesting that travel arrangements be charged to your credit card account. You agree that you will pay for all such purchases and will not hold Moments of Sonder Travel responsible for any actions pursuant to this power of attorney.

Booking Accuracy

Customer is required to immediately review all aspects of their booking confirmation to verify (but not limited to): passenger names, mailing address, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities. Please notify Moments of Sonder Travel immediately if any omissions or corrections are needed.

Customer voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. The name, date of birth, and gender that appear on your passport or government-issued ID must exactly match the same data listed on airline tickets and booking records. When you receive any travel documents, it is the sole responsibility of the Customer to review and verify all information and to contact Moments of Sonder Travel immediately if changes are required.

For some itineraries, you may be required to provide Moments of Sonder Travel with color copies of each traveler's passport photo and signature page within 5 days of booking or with your final payment, whichever is sooner.

California Seller of Travel

Moments of Sonder, LLC is registered as a Seller of Travel with the California Attorney General's Office. California Seller of Travel Number: CST# 2164906-40. Registration as a seller of travel does not constitute approval by the State of California. (Bus. & Prof. Code, § 17550.24.)

Under certain circumstances, California consumers may recover money paid for travel services not provided by a registered seller of travel. Moments of Sonder Travel participates in the Travel Consumer Restitution Corporation (TCRC) as required under California law. For information on the TCRC and your rights as a California consumer, please contact the California Attorney General's Office or visit oag.ca.gov/travel.

California consumers have specific rights under the California Consumer Privacy Act (CCPA) with respect to their personal information. Please refer to our Privacy Policy for full details on how we collect, use, and protect your personal data.

General Provisions
Governing Law & Jurisdiction

The laws of the State of California, USA govern these Terms and Conditions. You consent to the exclusive jurisdiction and venue of courts in Contra Costa County, California, in all disputes arising out of or relating to travel bookings with Moments of Sonder Travel. All suits in connection with this agreement shall be litigated in those courts, and you hereby submit to the personal jurisdiction of those courts. All claims must be submitted in writing within 30 days after the return of your trip.

Entire Agreement & Severability

These Terms and Conditions constitute the entire agreement between the Customer and Moments of Sonder Travel with respect to travel bookings and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original, and the agreement shall continue in effect.

Use of Website & Information

Use of the Moments of Sonder Travel website is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms and Conditions. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents originally generated and maintained in printed form.

Client Reviews & Social Media Content
Testimonials & Reviews

By providing a testimonial, review, or written feedback to Moments of Sonder Travel, whether via email, direct message, a post-trip follow-up conversation, or any other means, you grant Moments of Sonder Travel a non-exclusive, royalty-free license to reproduce, publish, and display that content in marketing materials, on our website, and across our social media platforms.

Testimonials will be attributed by first name and general travel type (for example, "Sarah, Paris Anniversary Trip") unless you request anonymity in writing. Your full name, contact information, or any other personally identifiable information will never be shared without your explicit written consent. If you wish to withdraw a previously submitted testimonial, please contact Moments of Sonder Travel in writing and it will be removed promptly.

Social Media & Itinerary Content

Moments of Sonder Travel may share general destination highlights, itinerary concepts, travel recommendations, and curated travel content across social media platforms including Instagram, Facebook, TikTok, and others. This content may be informed by trips planned and booked on behalf of clients, including destination details, property highlights, and experience recommendations.

Moments of Sonder Travel will never share the following without your explicit written consent:

  • Your name, identity, or any personally identifiable information
  • Photographs or images in which you or members of your party appear
  • Specific private details of your trip that could identify you
  • Financial details related to your booking

General destination content, property highlights, and travel inspiration drawn from the work Moments of Sonder Travel performs does not constitute disclosure of your personal information and may be shared in the ordinary course of marketing the agency's services. If you have specific concerns about privacy, please communicate them in writing at the time of engagement and Moments of Sonder Travel will note your preferences in your client record.

Opt-Out

If you prefer that no aspect of your engagement with Moments of Sonder Travel, including general destination content, be referenced in any form of marketing or social media, please notify us in writing at the time of booking. We will honor all such requests. This preference will not affect the quality or terms of service provided to you.

Your Acceptance of These Terms

By engaging Moments of Sonder Travel's services by any of the means listed below, you acknowledge that you have been advised of, reviewed, and agree to these Terms and Conditions. These conditions apply to yourself and all traveling companions on whose behalf you make bookings.
